Location-Based Services Terms of Use

Article 1 (Purpose)

These Terms are intended to set out the rights, obligations, and responsibilities between Balbadak (hereinafter the "Company") and the personal location information subject (hereinafter the "User"), as well as other necessary matters, with respect to the location-based services provided by the Company.

Article 2 (Business Operator Information)

Article 3 (Contents of the Service and Fees)

• Real-time location sharing: Displays the User's current location to approved members of a group selected by the User, for a duration set by the User.
• Route (track) display: While sharing is on, the route travelled is drawn as a line on the map.
• This service is provided free of charge. However, data communication charges borne by the User are subject to the policies of the mobile carrier.

Article 4 (Method of Collecting Personal Location Information)

The Company collects location only from the moment the User starts sharing until the moment it ends, via the device's GPS, Wi-Fi, and cell tower signals.

• When sharing is not turned on, no location is collected or stored on the server.
• To reduce battery consumption, location is recorded only after the device has moved a certain distance.
• Recording continues while sharing is on even if the app screen is off. In that case, a notification indicating that sharing is in progress remains displayed in the device's status bar.
• Sharing ends automaticallyWhen starting, the User chooses 3, 6, 9 or 12 hours, or no limit. With a set duration, sharing ends automatically at that time and a notification is sent 10 minutes before. With no limit, sharing continues until the User turns it off, and the app gives a reminder every 24 hours.

Article 5 (Purpose of Use/Provision and Recipients of Personal Location Information)

The Company does not use personal location information for any purpose other than the above, and does not provide it to any third party other than the group members designated by the User. An exception applies where an investigative agency or similar authority makes a request through lawful procedures in accordance with the Act on the Protection and Use of Location Information and other relevant laws.

Where the Company provides personal location information to a third party, it notifies the User in advance of the recipient and the purpose of provision and obtains consent.

Article 6 (Purpose and Period of Retention of Personal Location Information)

Once the purpose of using or providing personal location information has been achieved, the Company destroys it without delay in accordance with the criteria above, and electronic files are deleted in an irrecoverable manner.

Article 7 (Basis and Period for Retaining Records Confirming Use/Provision of Location Information)

Pursuant to Article 16(2) of the Act on the Protection and Use of Location Information, the Company automatically records and retains for 6 months, in its location information system, the records confirming the use and provision of location information.

• Items retained: sharing start/end times, the group shared with, and the number of coordinates recorded
• The actual location coordinates are not included in these records. Coordinates are destroyed immediately in accordance with Article 6.
• These records may be viewed only by the User and are not disclosed to other users or group members.

Article 8 (Rights of the User and How to Exercise Them)

• The User may withdraw consent to the collection, use, and provision of personal location information at any time. This can be done immediately in the app under [My Info] → [Withdraw Location Sharing Consent]; upon withdrawal, any sharing in progress ends and stored routes are destroyed.
• The User may temporarily suspend collection at any time during sharing using the [Stop Sharing] button. The Company may not refuse such a request and maintains the technical means to honour it.
• The User may request access to and notification of the following records and, where there is an error, may request correction. The Company does not refuse such requests without just cause.
  • Records confirming the use and provision of location information concerning the User
  • The reasons for and contents of any provision of the User's personal location information to a third party
• Rights may be exercised through in-app features or via the contact in Article 10.

Article 9 (Rights of Guardians of Children Aged 8 or Under, etc.)

Where consent to the use and provision of personal location information is given for the protection of the life or body of any of the following persons (hereinafter "children aged 8 or under, etc."), the Company deems the guardian's consent to be the consent of the person concerned.

• A child aged 8 or under
• A person under adult guardianship
• A person with a mental disability under the Act on Welfare of Persons with Disabilities who qualifies as a person with a severe disability under the Act on the Employment Promotion and Vocational Rehabilitation of Persons with Disabilities (limited to persons registered as disabled under the Act on Welfare of Persons with Disabilities)

A guardian who wishes to give consent on behalf of a child aged 8 or under, etc. must submit to the Company, in writing or by an equivalent method, documentation proving guardian status together with an expression of intent to consent. A guardian who consents to the use and provision of the personal location information of a child aged 8 or under, etc. may exercise all of the User's rights under Article 8.

※ Balbadak restricts sign-up by children under the age of 14.

Article 10 (Location Information Manager)

In order to properly manage and protect personal location information and to handle User complaints smoothly, the Company designates and operates a Location Information Manager as follows.

Article 11 (Damages and Dispute Resolution)

• Where a User suffers damage due to the Company's violation of Articles 15 through 26 of the Act on the Protection and Use of Location Information, the User may claim damages against the Company. In such a case, the Company cannot be relieved of liability unless it proves the absence of intent or negligence.
• Where a dispute concerning location information arises between the Company and a User, it shall in principle be resolved through mutual consultation.
• If consultation does not succeed, the User may apply for adjudication or dispute mediation to the Personal Information Dispute Mediation Committee under Article 40 of the Personal Information Protection Act, or to the Korea Communications Commission.

Article 12 (Changes to and Suspension of the Service)

In the event of suspension or closure of the location-based services business, or discontinuation of all or part of the Service, the Company will notify Users in advance of the reasons and timing via in-app notice or email. Where advance notice is not possible for unavoidable reasons, notice will be given without delay after the fact.

Article 13 (Amendment of These Terms)

Where the Company amends these Terms, it will post notice in the app from 7 days before the effective date, specifying the amended contents and the effective date. However, where the change is unfavourable to Users, notice will be given from 30 days before, and for any User who expressly indicates a refusal, the previous Terms will continue to apply.

Addendum: These Terms take effect on August 21, 2026.
